FACTS:

Dr. Pablo Ruiz, a Mexican citizen and new professor at the University of Texas , moved from Mexico to the United States with his 6-year-old son on January 1, 2015. He is currently residing in the United States on a J-1 visa, and he and his son have not lived in the United States in any previous years. His son has a J-2 visa, but, unlike Dr. Ruiz, he does not have a social security card or a taxpayer identification number. Ruiz is not married, and he fully supports his son who has lived with him the entire year.

ISSUES:

Professor Ruiz has asked you:

1) Whether he should file his 2015 tax return as a resident or nonresident alien.

2) He is also not sure about his filing status

3) Whether he can claim his son on his tax return.
